First of all, I have a card and am a legal MMJ patient. Yesterday, with my wife and some friends, we passed through the Border Patrol checkpoint just north of Tombstone on AZ80. The sniffing dogs came by and sniffed. As it turns out, I was not carrying any medicine, and we were waved through. The question now is: What is the status of a legal patient in AZ, with a card, who is pegged by a dog and thus the Border Patrol? A secondary and perhaps more important question is: What is the smallest amount of medicine perceivable by a dog? If one has less than, say, 1/2 gram, and that carried in a fanny pack, can the pooch smell it?
My guess is that you want to stay away from Border patrol as much as possible(yes the state law allows mmj) but the border patrol is a federal branch(and therefore it is still illegal to them) .
Before i was a patient i was traveling through to california with about a gram in a small jar and passed maybe three checkpoints with sniffin' mutts and they never picked it up. But STAY AWAY FROM CHECKPOINTS at all costs because it could turn into something it shouldnt for some medicine.
they can smell any amount even small amounts of residue on your hands, steering wheel, or containers. dont bring anything though the checkpoints if you are not shure if you will be searched or not
yah don't risk it I know a patient that got into trouble down there at the checkpoint by tombstone, the border patrol stated they were federal agents and that marijuana was still illegal to them and that the marijuana law didn't apply to them.
Avoid any / all federal land (i.e reservations, BLM property, etc.) as that is Federal land and your AZ Prop 203 card will not offer you any protection.
Any other areas of Arizona, you are protected, under Prop 203, as long as you are in possession of less than 2 1/2 ounces, per card holder (other rules apply if you are a state recognized caregiver).
