there is a huge diff between a fed checkpoint on a fed highway and a fed checkpoint on a state highway. I have been stopped many times at checkpoints, most of the time I dont have any meds. So far in Arizona, since the incident in Yuma where the patient got her meds back, BP and Customs does not prosecute patients, they will take your meds, but will let you go.....Whatever you do DO NOT EVER EVER EVER tell them that you grow if you do.
The sad facts are there is a 100 mile "zone" 360 degrees encircling all of America, named Constitutional Free Zones. Basically if you are within 100 miles of a border or shoreline, Federal cops can infringed certain Rights, such as your 5th Amendment Rights. Attorneys advice is just answer yes sir, American citizen, and 99% of the time you will be waived through no issues.
Another issue is Reservations. Many highways pass through native American Reservations. These Reservations are considered Federal property, and Federal Laws prevail. We had a patient pulled over in Scottsdale on the 101 while passing through Reservation property. 60+ year old terminal patient. Reservation cop found 2.5 grams of medical marijuana. Arrested the patient, seized his car (BMW) and took him to jail. Our patient called me the next day in tears. This man is terminal, doesn't need anything further to have to worry about, but now after 60+ years arrest free (combat Veteran, retired successful small business owner) now he is forced to pay $$$$$ in attorney fees and hopefully he does not suffer any jail time.
Best rule is keep your medicine at home, with the rest of your medicine. I would also suggest you never carry a smoking device with your medicine if you are driving. It is not legal to use mmj while driving. I've been told a cop can right you for DUI if you are found with medicine and a smoking device.
